By Neema Mujesia,
Today, our CEO, Dr. Grace Githaiga, participated in a crucial interview reflecting on KICTANet’s ongoing relationship with the Office of the Data Protection Commissioner (ODPC). The discussion highlighted our contributions to data protection in Kenya and the importance of keeping the ODPC independent and free from external influence.
KICTANet and the Four Pillars of Digital Rights
As a key player in Kenya’s digital landscape, KICTANet operates under four core pillars:
- Policy and Regulation – Advocating for progressive laws and policies.
- Capacity Building – Educating diverse stakeholders on digital rights.
- Research and Innovation – Providing evidence-based insights.
- Multi-Stakeholder Engagement – Fostering collaboration between government, civil society, and the private sector.
The Journey with ODPC: From Policy to Implementation
KICTANet’s engagement with ODPC predates the enactment of the Data Protection Act, as we played a pivotal role in advocating for its formation. Our efforts have extended beyond policy discussions—actively contributing to task forces, stakeholder engagements, and public consultations to shape Kenya’s data protection framework.
In assessing ODPC’s performance, we recognize significant strides made in data privacy enforcement. However, challenges remain, particularly in public awareness and digital literacy. Data protection is not just a legal requirement; it is a fundamental human right that every Kenyan—youth, children, and the elderly—must understand and embrace.
Why Data Protection Matters Now More Than Ever
The rise of technology has exposed personal data to unprecedented risks. As Dr. Githaiga emphasized, “Due to technology, the privacy of data has been breached. We need to raise awareness. Youth, children, the elderly—everyone should be educated about data protection. No one should be left behind.”
KICTANet has been at the forefront of this effort, working closely with ODPC to sensitize citizens on their data rights. Additionally, through our collaboration with the UK Government’s Digital Access Programme (DAP), we have advanced awareness campaigns and training sessions that empower organizations and individuals with practical data protection strategies.
The Independence of ODPC: A Call to Action
The ODPC is a critical institution that must remain independent, free from political interference and the undue influence of big tech. As Dr. Githaiga stated, “We must safeguard our data, and we must safeguard the ODPC.” This is not just about compliance; it is about ensuring that data protection remains a cornerstone of Kenya’s digital transformation.
Are We Ready?
As we continue to strengthen Kenya’s data protection ecosystem, we must ask ourselves: Are we truly prepared to uphold digital privacy for all?
KICTANet remains committed to this cause. From policy advocacy to stakeholder training, we have been instrumental in shaping Kenya’s data governance landscape. Our journey with ODPC continues, and we look forward to further engagements that drive meaningful change in data privacy and security.
